THESE TERMS OF USE MUST BE READ BEFORE USING THE SITE. THE USAGE OF ANY PART OF THE SITE INDICATES ACCEPTANCE OF THESE TERMS OF USE.

The www.godasky.com site and the app (“Site”) is managed by PT. Godasky Nusa Tourindo including its subsidiaries and affiliated companies (“we”, “us”, “our” or “Godasky”). We ask that you read the Terms & Conditions (“Terms”) below carefully. By accessing and using the Site and Services, you acknowledge that you have read, understood, and agree with these Terms & Conditions. If you do not agree to be bound by these Terms, in whole or in part, then you may not access or use any services of the site. These Terms constitute a binding legal agreement between you as an individual user (“you” or “your”) and Godasky.

Please note that we reserve the right to modify, add, delete or correct (“changes”) at any time and each of these terms may be changed from time to time and are effective immediately upon posting such changes on the Site. We encourage you to periodically review this page for any changes. By continuing to use or access the Site and/or Services after such changes to these Terms, you hereby agree and consent to these changes.

Product and Services

We do our best to provide accurate and up-to-date information on our website, our quotation system accesses both live pricing and static pricing depending upon the supplier. but errors may occur. Promotion on our website of a Supplier’s travel offer for Travel Services (Travel Offer) does not constitute a legally binding offer, but rather, an invitation to book travel subject to our inventory allocation system.

We reserve the right to accept or reject your order for any reason (or no reason) at any time after that order has been made, including, but not limited to, the unavailability of any product or service, an error in the price or product or service description, or an error in your order. If we cancel your order, we will provide a full refund of any payment received. Once placed, you cannot cancel your order except as set out in this agreement.

The products displayed on our site are supplied and operated by third parties (“Partners”) who have collaborated and established ties, either directly or indirectly with Godasky. By making travel bookings on our Site or with one of our agent partners, or otherwise purchasing any travel services offered by Godasky. You understand and acknowledge that:

1. You are at least 18 years of age and have the legal authority to create a binding legal obligation
2. Bookings and Purchases that you made through www.godasky.com constitute a legal relationship and binding contract between you and Godasky Partners. In this case www.godasky.com acts as an agent or intermediary to facilitate transactions between you and Godasky partners.
3. Data and information related to certain products that Godasky lists on the Site is data and information that Godasky receives from Partners, and Godasky publishes such data and information in accordance with the data and information that Godasky receives.
4. Godasky has no control over the data and information provided by Godasky Partners, and Godasky does not guarantee that the data and information displayed is accurate, complete, or correct, and free from errors.
5. You guarantee that the data and information you provide to Godasky, whether in connection with reservations or registration on our Site, is accurate, current and complete. For terms of use of the data and information you provide, please refer to the Privacy Policy.

Bookings and Prices

In order to confirm your chosen Booking, you must pay a non-refundable deposit. Ordering/Purchasing Products is considered successful or complete after you have made payment in full and Godasky issues and sends you a Confirmation Letter for ordering/purchasing or an Electronic Ticket or Electronic Voucher. If there is or occurs a dispute or problem, then the data contained in Godasky will be the main reference and is considered valid.

By completing your order/purchase, you are deemed to agree to receive:

• an email that Godasky will immediately send shortly before the service date you ordered, providing you with information about the Product you purchased, and providing you with certain and contain helpful information including a timeline of what the traveller can expect will happen next, and offers (including offers third parties that you have personally selected) related to your booking and destination;
• an email that Godasky will send shortly after the date of service to invite you to complete the Godasky Product user review form, Godasky will not send you notifications (desired or unsolicited), emails, further correspondence, unless specifically requested by you.

All prices of our published Travel Offers are listed in Indonesian Rupiah (IDR) unless stated otherwise. Godasky always strives to provide the best prices for products that can be ordered. Prices listed may have special terms and conditions, so you should check for yourself and understand the specific terms and conditions that apply to a particular price or rate before you make an order.

Godasky has the right to change the price of a product at any time without prior notification, however, the Product that has been purchased by you and for which Product you have received an Electronic Ticket or Electronic Voucher will not change.

From the time of your booking confirmation until your final payment; your price may only be changed if:

• you request Changes or Customizations to your booking;
• new or increased government taxes or fees are implemented that apply to your package or its components;
• vendor costs applicable to your package or its components increase;

Under any of these circumstances, we will inform you how your package price will be affected.

Once your booking is fully paid the package price will not change, unless:

• you request Changes or Customizations to your booking;
• new or increased government taxes or fees are implemented that apply to your package or its components;

In either case, we will inform you how your package price will be affected.

You will also need to check and understand any special terms and conditions regarding cancellation and refunds that specifically apply to a particular Product and/or Price.

Payment

Payment can be made via bank transfer, credit card, or for eligible customers on selected products and services, and subject to applicable terms and conditions.

Your order will be confirmed with an Electronic Ticket or Electronic Voucher via email containing a description of the product and order you made as well as confirmation of payment. Make sure you keep proof of payment. The Electronic Ticket or Electronic Voucher is a very important document and you are responsible for printing and safeguarding the information stated on the Electronic Ticket or Electronic Voucher that Godasky sends and you are required to bring a printout of this Electronic Ticket or Electronic Voucher when you are going to use or pick up the Products you purchased.

Godasky or Godasky Partners have the right to refuse to provide Products or services, if you cannot prove that you have legally made an order and payment, and you release Godasky from all your responsibilities and losses in any form.

Changes and Cancellations

By purchasing products at Godasky, you are deemed to have understood, accepted and agreed, unless expressly stated otherwise in these Terms & Conditions and any additional terms and conditions imposed by Partners, all purchases of Products and Services at Godasky cannot be changed, cancelled, refunded, exchanged or transferred to another person/party.

Godasky will include cancellation terms and conditions on each Electronic Ticket or Electronic Voucher that Godasky sends to you.

Please note that certain rates or offers are not eligible for cancellation or change. It is your responsibility to review and understand your cancellation policy and terms in advance.

If you wish to review, make changes to, or cancel your order, please refer to the Electronic Ticket or Electronic Voucher and follow the instructions therein. Please note that you may be charged additional fees for cancellation in accordance with the cancellation policy.

Godasky reserves the right to:

• cancel the trip in case of not having the minimum quota of registered people/travelers to consolidate and execute the trip;
• change the date of departure or conclusion of the trip;
• modify any non-essential aspect of the trip;
• cancel or modify the trip or any routes within the trip or objectives set out in the itinerary;

Although it is unlikely that Godasky will cancel or change a booking that Godasky has confirmed on an Electronic Ticket or Electronic Voucher, if necessary Godasky will notify you as soon as possible.

Godasky will be responsible for changes that significantly affect the provisions of Products and Services that Godasky has previously confirmed, namely:

• Cancellation of orders;
• Change of date, or Product;

In the event that Godasky makes significant changes, you have the option to:

1. Accept changes that Godasky offers to other dates or Products; or
2. Receive a refund in the form of credit that you can use for future purchases of Products from the Godasky site; and for that you must notify Godasky within 10 (ten) calendar days regarding your choice, and if Godasky does not receive confirmation from you, then Godasky assumes you chose option “1”).

If you are paying by credit card you agree that in the event of cancellation you will be bound by the cancellation policies contained herein, and will waive your right to a chargeback, except in the case of fraud. If you do request a chargeback that we then have to dispute, you will be liable for all of our costs, including attorneys’ fees.

Godasky is not responsible for losses suffered by you, which are caused by any action or condition beyond reasonable circumstances by either you or us (Force Majeure Event), which include Force Majeure Events are not limited to natural disasters (floods, earthquakes, storms, typhoons, etc.), epidemics, riots, war, military actions, terrorist acts, embargoes, sanctions, changes in laws, demonstrations and so on.

Disclaimer of Liability

All data, information or content in any form available and published on this Site is provided as is and without warranty of any kind.

You acknowledge and agree that you bear all forms of risk regarding the use of the Site and Services. Furthermore, you acknowledge, understood and agree that Godasky, including every Partner and any other party collaborating with Godasky is not responsible for and does not provide guarantees regarding:

1. All matters relating to this Site including but not limited to the operation or accuracy of data, appropriateness, completeness of data;
2. whether express or implied, including implied warranties of purchase or fitness for a particular purpose or merchantability;
3. Loss or damage, whether direct, indirect, special, consequential or including loss of profits, reputation, damage/loss of data;
4. Your access to the Site, along with any damage that may arise as a result of your access to the Site or external sites. You must ensure that you are free and protected from viruses or other things that may interfere with or damage the operation of your computer system and such access is at your own risk.

Except as described in the terms and conditions herein, Godasky makes no guarantees whatsoever regarding any transactions conducted through, or in connection with, this site, and you understand and agree that such transactions are conducted entirely at your own risk. Any warranty provided with respect to any product, service, material or information available on or through a Godasky site from a third party is provided solely by such third party, and not by us or any other party from Godasky.

Miscellanea

If any provision of these Terms is so broad as to be unenforceable, such provision will be interpreted to be only so broad as is enforceable. The invalidity or unenforceability of any provision hereof will in no way affect the validity or enforceability of any other provision.

In all questions and controversies arising from or relating to these Terms and Conditions, the performance and use of this site, you hereby agree and submit to the non-exclusive jurisdiction of the courts of the Republic of Indonesia.
